By accessing, browsing, or purchasing from Femenya, you agree to be bound by these Terms, our Privacy Policy, and our Shipping & Return Policies. Please read them carefully.

1. Account Creation & User Eligibility

  • Age Requirement: By using this site, you affirm that you are at least the age of majority in your state or province of residence (or have obtained parental consent).
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials. Femenya is not liable for losses caused by unauthorized access to your account.
  • Right to Terminate: We reserve the right to suspend accounts, cancel pending orders, or refuse service at our discretion if fraudulent activity, misuse, or breach of these Terms is detected.

2. Product Specifications & Artisanal Disclaimers

A. Handcrafted Sarees & Apparel

  • Artisanal Variations: Our sarees feature traditional handblock printing, hand-loomed weaves, and delicate natural or pigment dyes. Minor inconsistencies in print, motif alignment, weave texture, or thread slubs are natural signatures of authentic handmade craft and do not constitute defects.
  • Saree Dimensions: Standard sarees measure 5.5 meters in length accompanied by an unstitched 1.0-meter blouse piece, unless explicitly specified otherwise on the product page.
  • Care & Maintenance: Products must be maintained strictly per the provided care instructions (e.g., Dry Clean Only for pure double diamond chiffon or handblock silks). Femenya is not responsible for damage resulting from improper home washing.

B. Jewelry & Accessories

  • Material Disclaimers: Jewelry listings clearly indicate whether items are fashion/imitation jewelry, silver-plated, brass, or handcrafted metalwork.
  • Wear & Tear: Plating tarnishing due to exposure to moisture, perfumes, hairsprays, or chemical solvents is standard for fashion jewelry over time and is excluded from quality claims.
  • Hygiene Standard: For hygiene reasons, worn or altered jewelry pieces (e.g., pierced earrings) may be subject to restricted return policies once the safety seal or packaging is broken.

C. Visual & Color Accuracy

  • We make every effort to display true-to-life product photography. However, slight color variations may occur due to studio lighting, professional screen calibrations, or your device’s display settings.

3. Pricing, Payments & Orders

  • Pricing & Currency: All prices are listed in Indian Rupees (INR, ₹) inclusive of applicable GST, unless stated otherwise.
  • Order Confirmation: Acceptance of your order occurs upon dispatch. We reserve the right to decline or limit order quantities prior to shipping due to stock availability, pricing errors, or payment verification failures.
  • Accepted Payment Modes: We accept payments via Credit/Debit Cards, Net Banking, UPI (GPay, PhonePe, Paytm), Wallet options, and Cash on Delivery (COD) for eligible pincodes.
  • Cash on Delivery (COD) Terms: COD orders require mandatory verification via phone/WhatsApp or automated OTP prior to dispatch. We reserve the right to restrict COD options for accounts with high Return-to-Origin (RTO) histories.

4. Shipping, Delivery & Risk of Loss

  • Dispatch Timelines: Orders are processed within 5 hours. Shipping times provided at checkout are estimates dependent on logistics partners.
  • Transit Insurance & Delivery: Risk of loss passes to you upon delivery by our carrier. High-value parcels (e.g., premium saree and jewelry shipments) above 5000 may require OTP authentication or signature upon delivery.
  • Address Accuracy: Femenya is not responsible for non-delivery caused by inaccurate address details provided at checkout. Re-routing charges may apply.

5. Cancellations, Returns & Refunds

  • Cancellation Policy:Orders can be canceled within 12 Hours of placement, provided dispatch has not occurred.
  • Return Conditions:Eligible items may be returned within 5 days of delivery, provided:

    • Items are unused, unwashed, and in original condition with all brand tags, polymailers, and jewelry boxes intact.

    • Customized/altered sarees (e.g., fall/pico completed, custom stitched blouses) and personalized jewelry are non-returnable.

  • Refund Processing:Upon receiving and passing quality inspection at our facility, refunds will be initiated to your original payment method or issued as store credit within 5–7 business days.

6. Intellectual Property Rights

  • All website content—including the brand name Femenya, logos, custom copy, product descriptions, photography, lookbooks, graphics, and visual code—is the sole intellectual property of Femenya.
  • You may not scrape, reproduce, re-publish, or commercialize any content or assets from this website without explicit, written consent from our management.

7. User-Generated Content & Social Media Grant

By posting reviews, tagging @Femenya [Shop.femenya] on social media, or uploading images to our site, you grant Femenya a non-exclusive, royalty-free, perpetual license to showcase, feature, or repost that content across our marketing channels, social platforms, and digital ads.

8. Limitation of Liability & Force Majeure

  • Limitation: To the maximum extent permitted by Indian law, Femenya shall not be liable for indirect, incidental, or consequential damages arising from site outages, delayed logistics deliveries, or product misuse. Our total liability for any claim shall not exceed the purchase price paid for the specific item in question.
  • Force Majeure: Femenya is not liable for performance delays or failures caused by events beyond our reasonable control, including natural disasters, acts of government, transportation strikes, or regional logistics disruptions.

9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any legal proceedings, disputes, or claims arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in, India.
